Terms of Use
Effective date:
These Website Terms of Use (the “Terms”) govern your access to and use of https://ddconstructionid.com (the “Website”), which is owned and operated by D&D Construction, LLC (“D&D Construction,” “we,” “us,” or “our”).
By using the Website you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.
The Website Is Informational
Everything on this Website is general information about the kind of work we do. It is not a bid, an estimate, a fixed price, a warranty, a guarantee of availability, or a commitment to take on any project.
Nothing here is engineering, architectural, structural, code-compliance, or legal advice. Concrete and construction outcomes depend on the specific site, soil, engineering, permitting, materials, and conditions of your project. Do not rely on general descriptions on this Website in place of an engineered design or a written quote for your own project.
Quote Requests
Submitting the quote request form starts a conversation. It does not create a contract, reserve a place in our schedule, or obligate either of us to proceed. A project becomes binding only under a separate written agreement signed by D&D Construction.
If there is any conflict between this Website and a signed construction agreement, proposal, or written quote, that signed document controls.
Project Photographs
Photographs on this Website show past D&D Construction work. They illustrate the type of work we perform. They are not a representation that your project will look the same, cost the same, take the same time, or use the same methods or materials.
Intellectual Property
The Website and its contents, including text, photographs, graphics, logos, designs, page layouts, and marks, are owned by or licensed to D&D Construction and are protected by intellectual-property laws.
You may view and print pages for your own non-commercial use in evaluating our services. You may not copy, reproduce, modify, distribute, publish, sell, license, or create derivative works from Website content without our prior written permission, except as permitted by applicable law or as described in “Search Engines and AI Assistants” below.
Acceptable Use
You agree not to:
- Use the Website in violation of any law, regulation, or third-party right.
- Submit false, fraudulent, abusive, or misleading quote requests.
- Interfere with, disrupt, damage, overburden, or attempt to gain unauthorized access to the Website, its servers, or its networks.
- Introduce viruses, malware, or any code intended to damage or disrupt the Website.
- Remove, obscure, or alter any proprietary notice.
- Impersonate any person or misrepresent your affiliation with any person or entity.
Search Engines and AI Assistants
We want people to find us. Search engines, AI assistants, and answer engines may crawl, index, summarize, and cite the public content of the Website so that people can discover our business. Nothing in these Terms restricts that activity. The restrictions in this section and in “Intellectual Property” do not apply to it.
Third-Party Services
The Website relies on third-party providers for hosting and for delivering form submissions, and may link to third-party websites. Those third parties control their own content, availability, security, and policies, and your use of them is governed by their terms.
Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. D&D CONSTRUCTION DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.
WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ITS CONTENT WILL BE COMPLETE, CURRENT, OR ACCURATE.
This section applies to the Website only. It does not limit, waive, or disclaim any warranty we give in a signed construction agreement for work we actually perform, and it does not affect any right you have under Idaho construction law.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, D&D CONSTRUCTION AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow certain warranty exclusions or liability limitations, so parts of the two sections above may not apply to you. Again, these limits concern the Website, not the construction work itself.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless D&D Construction and its owners, officers, employees, agents, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of the Website, or your violation of another person’s rights.
Governing Law and Venue
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles. Except where applicable law requires otherwise, any dispute arising out of or related to these Terms or the Website must be brought exclusively in the state or federal courts located in Twin Falls County, Idaho, and you consent to the jurisdiction and venue of those courts.
Changes
We may modify, suspend, or discontinue any part of the Website at any time, and we may update these Terms. Changes take effect when posted on this page with a revised effective date. Continuing to use the Website after that means you accept the revised Terms.
Severability and Waiver
If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
